1. The service
Shops in Kenya (shops.co.ke) provides hosted online storefronts, payment collection tools, a business directory and related services to vendors, and a shopping experience to customers. We act as a software platform — vendors are independent businesses selling their own products and services.
2. Accounts
You must provide accurate registration details and keep your credentials secure. You are responsible for everything that happens under your account. Staff accounts must only be given to people you authorise. We may suspend accounts that breach these terms or Kenyan law.
3. Selling on Shops
Vendors are solely responsible for their listings, prices, stock accuracy, deliveries, customer service and compliance with Kenyan consumer-protection and tax laws. You must not list illegal, counterfeit, dangerous or misleading items. We may remove content or stores that violate the law or these terms.
4. Payments
Where the platform collects payments on your behalf, funds settle to your own M-PESA till, Paystack account or manual payment details — we never hold vendor funds. M-PESA and Paystack transactions are subject to their providers' terms. You are responsible for verifying manual payments (e.g. payment proofs) before dispatch.
5. Subscriptions & billing
Paid plans bill monthly, quarterly or annually via the payment method enabled on the platform. Plan changes take effect immediately when no paid plan is active, or at the end of the current paid period when one is. Payments once consumed (activated plan time) are non-refundable except where required by law. Promotional placements bill separately and activate on confirmed payment.
6. Commission
We charge no commission on your sales. Payment-gateway fees charged by Safaricom or Paystack are between you and those providers.
7. Acceptable use
You must not misuse the platform — no fraud, spam, scraping, malware, infringement of others' rights, or attempts to access other stores' data. Rate limits and fair-use apply on shared infrastructure.
8. Content & licence
You keep ownership of the content you upload (product photos, descriptions, blog posts). You grant us a licence to host and display it to operate and promote the service. You must have rights to everything you upload.
9. Availability
We target high availability but do not guarantee uninterrupted service. Features may change as the platform evolves; material changes to paid features will be communicated.
10. Liability
To the maximum extent permitted by law, Shops in Kenya is not liable for indirect losses, lost profits, or disputes between vendors and customers. Our aggregate liability is limited to the plan fees you paid in the preceding 3 months.
11. Termination
You may close your store at any time. We may suspend or terminate accounts for breaches. Data is retained per our privacy policy after closure.
12. Governing law
These terms are governed by the laws of Kenya. Disputes are subject to the courts of Kenya, Nairobi.
